Das BVerfG hat das in der Vergangenheit zwar durchaus abgelehnt, aber das muss nicht heißen, dass sie es auch weiterhin untersagen.
Der EUGH hat es in der Vergangenheit auch nur in sehr engen Grenzen zugelassen, bis es dann seit 2024 für im Grunde alles geht.
