You can absolutely pet the penguins. Just, don’t. As far as king and emperor penguins go, anyway, the adult ones have no land predators so they’re pretty much completely unfussed about people approaching them.
Another thing, though. People see an African penguin or an Adelie or similar at a zoo and they think all penguins are little cuddly football sized waddlers. I imagine most people would be completely unprepared for the sheer scale of an adult emperor penguin:

You probably shouldn’t, but you definitely can. Law enforcement is pretty sparse. As long as you don’t bring witnesses or record your crime, you can pet penguins at will. Again, you shouldn’t, because it’s not good for the penguins.
I hope so, too, and there’s a good chance of it. It’s not very common to accidentally wander into Antarctica. I believe it’s population has the highest percentage of PhDs of any continent, most of them in science. While I realize that doesn’t guarantee beneficence, I feel like it goes a long way.
People gonna see this and move to Antarctica, only to find out you can’t pet the penguins. We’re here just to suffer.
